3. Personal Data Processed

The personal data provided to us by consumers participating in our market research studies will be provided by the consumer themselves or by their legal representative.

When registering on our portal as an interested consumer, we will request the following market research data: first name, surname, email, telephone number, IBAN, address, age, gender, nationality, education level, profession, place of purchase, family income, family status, allergies and intolerances.

When participating in market research studies, we will process the following personal data: behavioural data relating to the tested products (interest, attention, etc.) or physical reactions (body language, heart rate, galvanic skin response, etc.).

4. Purpose of the Processing of Personal Data

Consumers’ personal data will be processed to allow them to register on the consumer portal and to contact them by email in order to complete the consumer registration form.

Once your data has been collected, it will allow us to identify you as a potential participant in our market or research studies and analyse your consumer profile to determine whether it matches the requirements of clients requesting us to conduct market or research studies, and to ensure that participation does not pose a health risk in the event of allergies or intolerances.

If you have been selected for a study, we will contact you to inform you and ask whether you wish to participate in the market or research studies for which you have been selected, and to enable your participation if you agree.

During participation in the studies, personal data will be processed that will allow us to prepare a report on the level of satisfaction with the tested products. To do so, behaviour towards the product (interest, attention, etc.) or physical reactions (body language, heart rate, galvanic skin response, etc.) will be analysed. All this will enable us to issue an overall consumer assessment of the product under study, but never to create profiles of your personality.

Likewise, personal data will be processed to pay the compensation for participation in the studies, as well as to deregister consumers when requested, handle complaints, manage accounting, maintain the relationship, respond to enquiries, conduct surveys, manage incidents, and for other purposes necessary to comply with such relationship, with the laws applicable to us and with our legitimate interests.

5. Legal Basis

The processing of consumers’ personal data will only be possible if they have accepted this policy by ticking the relevant boxes provided in the consumer registration form and in the prior registration portal used to apply to become a consumer, which also serves as access for consumers who have already registered.

This constitutes express, free, informed and unequivocal consent, since we inform you of this policy and, after reading and agreeing to it, you may voluntarily authorise us to process your data by ticking the aforementioned boxes.

In this regard, we inform you that you may change your mind and withdraw your consent at any time by contacting privacy@ainia.es.

If the user is under 18 years of age, we will not process their personal data and, if they wish to participate in our studies, they must be registered by their parent or legal representative within their own consumer profile.

6. Security Measures

We guarantee the proper use of information and the confidentiality of the personal data collected during the relationship, applying all necessary security measures to safeguard its integrity, confidentiality and availability. Ultimately, this ensures compliance with our entity’s obligations regarding the protection of personal data.

7. Disclosure of Data

As a general rule, our entity does not disclose personal data to third parties without prior consent, although your personal data may be disclosed to third parties when legally required (e.g. Tax Agency), or to entities necessary to pay the compensations (e.g. banking institutions).

In general terms, we may disclose your personal data to Judges, Courts, the Public Prosecutor’s Office and/or competent Public Administrations in the event of claims where we are legally obliged to do so or where our legitimate interest prevails over the rights of the data subjects.

No international transfer of data to countries outside the European Union, the European Economic Area, or countries without equivalent guarantees is envisaged.

Retention of Your Data

As there are economic transactions between AINIA and consumers, in order to comply with current tax and accounting legislation, we will be obliged to retain consumers’ data for at least 6 years after the termination of the relationship with our entity.

Rights of Consumers

Consumers have the right to exercise their right to erasure and have the right to request access to their personal data at any time, rectify inaccurate data, object to or restrict the processing of their personal data, as well as request data portability or revoke previously granted consent.

To exercise these rights, you must do so in writing to privacy@ainia.es, enclosing a copy of your ID card or equivalent document to facilitate your identification.
