Cette notification, r\u00e9alis\u00e9e dans le cadre de <strong>l\u0092Accord sur les mesures sanitaires et phytosanitaires (SPS\/MSF)<\/strong>, confirme la port\u00e9e internationale et l\u0092impact commercial potentiel de cette future r\u00e9glementation.\n<h2><strong>Contexte et justification de la proposition<\/strong><\/h2>\nLes MOAH constituent un groupe de contaminants pr\u00e9sentant un <strong>potentiel g\u00e9notoxique et canc\u00e9rog\u00e8ne<\/strong>, en particulier les compos\u00e9s comportant trois cycles aromatiques ou plus. \u00c0 la lumi\u00e8re de la <strong>mise \u00e0 jour de l\u0092\u00e9valuation des risques de l\u0092EFSA (2023)<\/strong> et des donn\u00e9es de contr\u00f4le recueillies par les \u00c9tats membres, la Commission estime n\u00e9cessaire d\u0092\u00e9tablir des <strong>limites maximales juridiquement contraignantes<\/strong> afin de garantir un <strong>niveau \u00e9lev\u00e9 de protection de la sant\u00e9 humaine<\/strong>.\n\nLa notification \u00e0 l\u0092OMC confirme que :\n<ul>\n \t<li>Il n\u0092existe actuellement aucune <strong>norme internationale (Codex)<\/strong> applicable aux MOAH.<\/li>\n \t<li>La mesure est justifi\u00e9e exclusivement par des <strong>raisons de s\u00e9curit\u00e9 alimentaire<\/strong>.<\/li>\n \t<li>Elle affectera potentiellement <strong>tous les partenaires commerciaux de l\u0092UE<\/strong>.<\/li>\n<\/ul>\n<h2><strong>Que pr\u00e9voit la proposition ?<\/strong><\/h2>\nUn nouveau <strong><a href=\"https:\/\/members.wto.org\/crnattachments\/2026\/SPS\/EEC\/26_01382_01_e.pdf\">point 5.5 \u00ab Hydrocarbures aromatiques d\u0092huiles min\u00e9rales \u00bb<\/a><\/strong> est introduit dans <strong>l\u0092annexe I du r\u00e8glement (UE) 2023\/915<\/strong>, \u00e9tablissant des <strong>teneurs maximales en MOAH (? C10\u0096? C50)<\/strong> dans une tr\u00e8s large gamme de denr\u00e9es alimentaires, d\u0092<strong>origine v\u00e9g\u00e9tale comme animale<\/strong>, y compris les produits transform\u00e9s.\n\nConform\u00e9ment aux pr\u00e9c\u00e9dentes mises \u00e0 jour du r\u00e8glement (UE) 2023\/915, les modifications propos\u00e9es reposent sur deux piliers :\n<ul>\n \t<li><strong>Principe ALARA<\/strong>, en fixant les limites, dans de nombreux cas, \u00e0 la <strong>limite de quantification (LOQ)<\/strong>.<\/li>\n \t<li><strong>Application progressive<\/strong>, avec des <strong>p\u00e9riodes transitoires \u00e9chelonn\u00e9es<\/strong> pour permettre l\u0092adaptation des op\u00e9rateurs, notamment dans des matrices complexes telles que les huiles et les mati\u00e8res grasses.<\/li>\n<\/ul>\n<h2><strong>Quels aliments sont concern\u00e9s ?<\/strong><\/h2>\nLes principaux groupes d\u0092aliments concern\u00e9s par la proposition notifi\u00e9e \u00e0 l\u0092OMC sont les suivants :\n<h3><strong>Huiles et mati\u00e8res grasses<\/strong><\/h3>\nIl s\u0092agit de la cat\u00e9gorie pr\u00e9sentant le plus haut niveau de d\u00e9tail et de progressivit\u00e9 :\n<ul>\n \t<li><strong>Graines et fruits ol\u00e9agineux<\/strong> : 2,0 mg\/kg.<\/li>\n \t<li><strong>Huiles v\u00e9g\u00e9tales et graisses animales<\/strong> : limites diff\u00e9renci\u00e9es selon le type d\u0092huile, avec des valeurs initiales \u00e9lev\u00e9es (jusqu\u0092\u00e0 10 mg\/kg) progressivement r\u00e9duites \u00e0 <strong>2,0 mg\/kg en 2030<\/strong>.<\/li>\n \t<li>Dispositions sp\u00e9cifiques pour <strong>l\u0092huile de grignons d\u0092olive<\/strong>, les <strong>huiles marines<\/strong> et les <strong>produits d\u00e9riv\u00e9s \u00e0 forte teneur en mati\u00e8res grasses<\/strong>.<\/li>\n<\/ul>\n<h3><strong>C\u00e9r\u00e9ales et produits d\u00e9riv\u00e9s<\/strong><\/h3>\n<ul>\n \t<li>Grains de c\u00e9r\u00e9ales et produits \u00e0 faible teneur en mati\u00e8res grasses : <strong>0,5 mg\/kg<\/strong>.<\/li>\n \t<li>Produits plus gras : limites de <strong>1,0 ou 2,0 mg\/kg<\/strong>, selon la teneur en mati\u00e8res grasses.<\/li>\n \t<li>Exception pour les c\u00e9r\u00e9ales destin\u00e9es \u00e0 la <strong>bi\u00e8re ou aux distillats<\/strong>, \u00e0 condition que les r\u00e9sidus ne soient pas commercialis\u00e9s comme denr\u00e9e alimentaire.<\/li>\n<\/ul>\n<h3><strong>Fruits \u00e0 coque, l\u00e9gumineuses et cacao<\/strong><\/h3>\n<ul>\n \t<li><strong>Fruits \u00e0 coque<\/strong> : 2,0 mg\/kg.<\/li>\n \t<li><strong>L\u00e9gumineuses<\/strong> : 0,5 mg\/kg.<\/li>\n \t<li><strong>Cacao et chocolat<\/strong> : limites sp\u00e9cifiques, avec application diff\u00e9r\u00e9e pour les f\u00e8ves de cacao (\u00e0 partir de 2030).<\/li>\n<\/ul>\n<h3><strong>Lait, produits laitiers et aliments pour nourrissons<\/strong><\/h3>\n<ul>\n \t<li>Lait : <strong>0,5 mg\/kg<\/strong>.<\/li>\n \t<li>Produits laitiers et aliments pour nourrissons : limites modul\u00e9es selon la teneur en mati\u00e8res grasses (0,5 \/ 1,0 \/ 2,0 mg\/kg). Ces groupes se distinguent par leur <strong>pertinence toxicologique<\/strong>, car ils concernent des populations sensibles.<\/li>\n<\/ul>\n<h3><strong>\u00c9pices, th\u00e9, compl\u00e9ments et additifs<\/strong><\/h3>\n<ul>\n \t<li><strong>\u00c9pices, herbes s\u00e9ch\u00e9es, th\u00e9 et tisanes<\/strong> : r\u00e9glement\u00e9s uniquement lorsqu\u0092ils sont utilis\u00e9s <strong>comme ingr\u00e9dient<\/strong> ou sous forme <strong>instantan\u00e9e<\/strong>.<\/li>\n \t<li><strong>Compl\u00e9ments alimentaires<\/strong> : limite initiale de <strong>10 mg\/kg \u00e0 partir de 2027<\/strong>, r\u00e9duite \u00e0 <strong>5 mg\/kg en 2030<\/strong>.<\/li>\n \t<li><strong>Additifs alimentaires<\/strong> : obligation que les mati\u00e8res premi\u00e8res utilis\u00e9es respectent les limites \u00e9tablies.<\/li>\n<\/ul>\n<strong>Aliments transform\u00e9s et compos\u00e9s.<\/strong> \u00c0 partir du <strong>1er janvier 2030<\/strong>, des limites sp\u00e9cifiques sont introduites pour les aliments transform\u00e9s et compos\u00e9s contenant des ingr\u00e9dients r\u00e9glement\u00e9s, l\u00e0 encore en fonction de la <strong>teneur totale en mati\u00e8res grasses<\/strong>.\n\n<strong>Dates cl\u00e9s confirm\u00e9es dans la notification \u00e0 l\u0092OMC.<\/strong> La notification SPS\/MSF de l\u0092UE fournit des informations calendaires particuli\u00e8rement pertinentes pour les op\u00e9rateurs internationaux :\n<ul>\n \t<li><strong>Adoption pr\u00e9vue du r\u00e8glement<\/strong> : <strong>septembre 2026<\/strong>.<\/li>\n \t<li><strong>Publication estim\u00e9e<\/strong> : septembre 2026.<\/li>\n \t<li><strong>Application g\u00e9n\u00e9rale<\/strong> : <strong>1er janvier 2027<\/strong>.<\/li>\n<\/ul>\nLa proposition peut faire l\u0092objet de commentaires de la part de pays tiers jusqu\u0092au 10 mai prochain dans le cadre de l\u0092Accord SPS\/MSF.\n\nUne fois approuv\u00e9e, un <strong>p\u00e9riode transitoire<\/strong> est pr\u00e9vue afin que les aliments l\u00e9galement commercialis\u00e9s avant la date d\u0092application puissent rester sur le march\u00e9 jusqu\u0092\u00e0 la fin de leur dur\u00e9e de vie.\n\nPar ailleurs, il convient de garder \u00e0 l\u0092esprit la date du <strong>1er janvier 2030<\/strong>, car c\u0092est \u00e0 cette \u00e9ch\u00e9ance que l\u0092application pleine et enti\u00e8re des limites d\u00e9finitives est propos\u00e9e, y compris pour les aliments transform\u00e9s.\n<h2><strong>Implications pratiques pour le secteur alimentaire<\/strong><\/h2>\nLa notification \u00e0 l\u0092OMC confirme que l\u0092UE consid\u00e8re cette mesure comme <strong>structurelle et de long terme<\/strong>. Pour les op\u00e9rateurs alimentaires, cela implique :\n<ul>\n \t<li>La r\u00e9vision des <strong>mati\u00e8res premi\u00e8res critiques<\/strong> (huiles, mati\u00e8res grasses, cacao, \u00e9pices).<\/li>\n \t<li>L\u0092identification et la ma\u00eetrise des <strong>sources de contamination<\/strong> (lubrifiants, mat\u00e9riaux au contact, proc\u00e9d\u00e9s).<\/li>\n \t<li>L\u0092adaptation des <strong>plans analytiques<\/strong>, en tenant compte de LOQ exigeantes.<\/li>\n \t<li>L\u0092anticipation dans les cha\u00eenes d\u0092approvisionnement avec une forte <strong>composante d\u0092importation<\/strong>.<\/li>\n<\/ul>\n<p data-start=\"800\" data-end=\"1390\">Dans ce contexte, chez AINIA, nous avons r\u00e9cemment analys\u00e9 les implications techniques et r\u00e9glementaires de ces contaminants dans le cadre d\u0092un webinar sp\u00e9cialis\u00e9, au cours duquel nous avons abord\u00e9 \u00e0 la fois le futur <strong>cadre l\u00e9gislatif europ\u00e9en<\/strong> et les <strong>d\u00e9fis analytiques et op\u00e9rationnels<\/strong> que leur contr\u00f4le pose \u00e0 l\u0092industrie alimentaire.
